4.2.3  Duty of Care Provisions of EPA 1990

EPA 1990 provides for a Duty of Care to ensure that:

  • Waste is properly disposed of, treated or stored through the introduction of a cradle to grave duty as holders of waste and ensuring that correct documentary procedures are followed.

  • Waste is prevented from escaping into the environment as required by the pollution control provisions of the EPA 1990 Comprehensive records for reference in an emergency are provided.

  • The Duty of Care (DC) is correctly implemented in order to improve standards of waste management by developing the correct procedures for minimising waste at source and thus avoiding excessive landfill tax.
