6.2.7  Local Air Pollution Control (LAPC)

As many industrial processes have a lower polluting potential than those regulated by IPC these are therefore outside the scope of IPC. Such processes are known as Local Air Pollution Control (LAPC) processes and are regulated by the local authority. Part I of the EPA 1990 covers this, but it is the District Council, Borough Council or Port Health Authority that enforces LAPC and also the smoke, grit and dust controls of the Clean Air Act 1993. Another significant difference between the IPC and LAPC regimes is that in LAPC, the BPEO concept is not applicable as it only deals with releases to one environmental media- air. The basic controls are the same for both regimes namely:

  • Making the information public.
  • Variation of process authorisation.
  • Keeping up to date with development in BATNEEC and to review authorisations every 4 years.
  • Review and reissue BATNEEC Guidance Notes every 4 years.
