7.3.5  Environmental Provisions

The Register of Environmental Regulations can be of a format of your choice but needs to be more than just a table of applicable legislation to your site. It should show which parts of the legislation are applicable to the relevant areas, activities, effects or processes on site. Hence it should avoid general statement as the Environment Act 1995 or the Environmental Protection Act 1990 without stating the applicable regulations or applicable area of your operations to which it relates.

The primary legislation such as EPA 1990 can be made more useful in this case when it is broken down into its constituent parts, which can then be related to specific significant effects. Therefore, for EPA 1990, the register may contain the following entries in various columns of the register:

  1. Under the heading 'Statutes' (the primary legislation) these could be written as:
    Environmental Protection Act 1990
    Part I: Integrated Pollution Prevention Control and Air Pollution Control by Local Authorities.
    Part II: Waste on Land, including Part IIA concerning contaminated land.
    Part III: Statutory Nuisance and Clean Air Act.


  2. Under the heading orders and regulations (that apply to the relevant part of the statutes) there could be:
    • Environmental Protection (Prescribed Processes and Substances) Regulations 1991, amended 1992 and 1993.
    • Environmental Protection (Applications, Appeals and Registers) Regulation 1991.
    • Environmental Protection (Authorisation of Processes) (Determination Periods) Order 1991.
    • Environmental Protection (Duty of Care) Regulations 1991.


  3. Under specific environmental provisions the following could read as:
    EPA 1990 is applicable to all, however there are also specific provisions of:
    Part I applies to the foundry, machine shop and paint shop which have both Schedule A (Environment Agency controlled) and Schedule B (Green Dales Borough Council controlled) processes.
    Part II is applicable to the handling of all controlled waste throughout the factory and the transfer of waste to licensed waste disposal contractors.
    Part III is applicable to the noise from the machine shop, the dust from the foundry and odours emitted from the paint and foundry shops.
