Licensing

COPA 1974 provides the foundations upon which the waste licensing regime contained within EPA 1990 is built, whereby all waste management processes now require a license.

Refer here to:

  • SI 1994 No 1096, The Environmental Protection Act 1990 (Commencement No.15) Order 1994 and SI 1994 No. 1056, The waste Management Licensing Regulations 1994.

  • DoE Circular 11/94 Environmental Protection Act 1990 Part II; Waste Management Licensing : the Framework Directive on Waste

  • Waste Management Paper No.4: Licensing of Waste Management Facilities (HMSO, 1994)

Specific provisions of the EA 1995

Licenses are only granted to 'a fit and proper person' and the waste activity must be the responsibility of a 'technically competent person.' (s.74(3) of the EPA). The licensee must also hold a certificate of competence under the EA 1995.
